ABOUT THESE TERMS
These Terms and Conditions govern your access to and use of nightweeds.com and any purchase made through the website. By using the website, creating an account, or placing an order, you agree to these Terms.

These Terms should be read together with our Privacy Policy, Shipping Policy and Returns Policy.
ELIGIBILITY
You must have legal capacity to enter into a binding contract. If you are under 18 years of age, you may use this website and place an order only with the consent and supervision of a parent or legal guardian.
By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the selected payment method.
ACCOUNTS
You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account. You must notify us promptly if you believe that your account has been accessed without authorisation.
We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, comply with law, or protect the security and operation of the website.
PRODUCTS AND MADE-TO-ORDER GOODS
Nightweeds products are produced after an order is confirmed. Products may be made to order, personalised, customised, printed or otherwise prepared specifically for the customer.
Product images and descriptions are provided as accurately as reasonably possible. Colours may appear differently depending on screen settings, lighting and photography. Minor variations in colour, placement, measurements, stitching, printing or finishing may occur as part of the production process and do not necessarily constitute a defect.
Where a product is made to the customer’s specifications or clearly personalised, cancellation and withdrawal rights may be restricted to the extent permitted by applicable law. This does not affect rights relating to defective, damaged, incorrectly supplied or materially non-conforming goods.
CUSTOMISATION INFORMATION
You are responsible for checking all names, numbers, spelling, sizing, colours and other customisation information before submitting an order.
Nightweeds is not responsible for errors that accurately reproduce information supplied or approved by the customer. Changes requested after an order has entered cutting, printing, customisation or production may not be possible.
ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the selected products. An order is accepted only after payment has been successfully authorised and Nightweeds has sent an official order confirmation email.
An automated acknowledgement, payment notification or account update does not by itself require us to fulfil an order where there is a payment failure, suspected fraud, a manifest pricing or description error, an unavailable product, an impossible customisation request, a legal restriction, or another genuine inability to fulfil the order.
If Nightweeds cancels an order after payment has been collected, the amount collected for the cancelled order will be refunded to the original payment method.
PRICES, CURRENCY AND TAXES
Prices are displayed and charged in United States dollars unless the checkout clearly states otherwise.
The order total and any taxes or charges collected by Nightweeds will be displayed before payment is submitted. Currency conversion charges imposed by a customer’s bank, card issuer or payment provider are not controlled by Nightweeds.
Customs duties, import taxes, handling charges and other destination-country fees not collected by Nightweeds are the responsibility of the customer. Further information is available in our Shipping Policy.
PAYMENT
Available payment methods are displayed at checkout and may include PayPal, Apple Pay or other payment methods made available by third-party payment providers.
Payments may be subject to authorisation, security checks, fraud screening and the terms of the relevant payment provider. Nightweeds does not receive or store complete payment card details where payment processing is handled by an authorised third-party provider.
An order may be delayed, declined or cancelled where payment cannot be authorised or where additional verification is reasonably required.
ORDER PROCESSING AND CHANGES
Orders are normally processed within 2-5 business days. Processing time is separate from estimated delivery time.
Requests to correct or cancel an order should be sent to [email protected] as soon as possible. Cancellation requests submitted within 24 hours of placing an order will be reviewed, but cancellation cannot be guaranteed if production has already begun.
After an order enters cutting, printing, personalisation, customisation or production, changes or cancellation may no longer be possible.
SHIPPING AND DELIVERY
Orders are prepared and dispatched from Guangzhou, China. Delivery destinations, estimated delivery times, tracking arrangements, shipping charges, customs responsibilities, delay procedures and lost-parcel procedures are described in our Shipping Policy.
Delivery estimates are guidance only and are not guaranteed delivery dates. Delays may occur because of customs clearance, weather, strikes, carrier disruption, incomplete addresses or other events outside our reasonable control.
CANCELLATIONS, RETURNS AND REFUNDS
Our cancellation, claim, return, refund, replacement and exchange rules are set out in our Returns Policy.
Customers should contact us within 7 calendar days after tracking shows an order as delivered if they need to submit a claim under our published procedure. This internal claim period does not limit any mandatory rights or remedies that cannot lawfully be excluded.
Change-of-mind returns, incorrect sizing selected by the customer, customer-supplied customisation errors and late cancellation requests may be excluded where permitted by law, particularly for goods made to the customer’s specifications or clearly personalised.
EVIDENCE AND RETURN AUTHORISATION
We may require photographs, an unedited unboxing video, packaging information, product labels, tracking information or other reasonable evidence when reviewing a claim.
Products must not be returned without written return authorisation. The approved return address and instructions will be provided after the claim has been reviewed. Sending a product to an unauthorised address may delay or prevent processing of the return.
INTELLECTUAL PROPERTY
The Nightweeds name, website design, graphics, logos, text, photographs, product presentations and other website content are owned by or licensed to Nightweeds and are protected by applicable intellectual property laws.
You may view and use the website for personal, non-commercial shopping purposes. You must not copy, reproduce, republish, sell, distribute, modify, scrape, commercially exploit or create derivative works from website content without prior written permission.
No purchase transfers ownership of Nightweeds intellectual property or grants permission to reproduce product artwork, graphics or website content.
ACCEPTABLE USE
You must not:
- use the website for unlawful, fraudulent or abusive purposes;
- attempt to gain unauthorised access to the website, accounts, servers or data;
- interfere with the security, performance or operation of the website;
- introduce malware, automated attacks or harmful code;
- use false identity, payment, delivery or account information;
- copy, scrape or extract website content for commercial use without permission;
- infringe the rights of Nightweeds or any third party.
We may restrict access, suspend accounts or cancel affected orders where reasonably necessary in response to prohibited conduct.
THIRD-PARTY SERVICES
The website may rely on third-party providers for payments, authentication, hosting, analytics, communications and delivery. Those providers may apply their own terms and privacy practices.
Nightweeds is not responsible for the independent acts, systems or policies of a third-party provider, but this provision does not remove any responsibility that Nightweeds cannot lawfully exclude.
Links to third-party websites are provided for convenience and do not constitute endorsement or control of those websites.
WEBSITE AVAILABILITY
We aim to keep the website accurate, secure and available, but uninterrupted or error-free access cannot be guaranteed.
We may update, suspend, restrict or withdraw website functions where reasonably necessary for maintenance, security, legal compliance or operational reasons. This does not affect an accepted order or mandatory consumer rights.
LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.
To the maximum extent permitted by law, Nightweeds is not liable for indirect, incidental or consequential loss that was not reasonably foreseeable when the contract was formed, or for loss caused by inaccurate information supplied by the customer, unauthorised account use, third-party systems, customs action, carrier disruption or events outside our reasonable control.
For consumer purchases, these Terms do not exclude any mandatory right or remedy available under applicable consumer law.
FORCE MAJEURE
Nightweeds is not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, epidemic or pandemic disruption, war, civil disorder, government action, customs action, strikes, transport interruption, carrier failure, telecommunications failure, power failure or major supply-chain disruption.
Where such an event affects an order, we will take reasonable steps to communicate with the customer and determine an appropriate next step.
GOVERNING LAW AND CONSUMER RIGHTS
These Terms and contracts formed through the website are governed by the laws of the People’s Republic of China.
This governing-law clause does not deprive a consumer of any mandatory protection that applies under the law of the consumer’s country or place of residence and that cannot lawfully be excluded by contract.
Before starting formal proceedings, customers are encouraged to contact Nightweeds so that the issue can first be reviewed and an attempt made to resolve it directly.
CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the website, products, business operations, payment methods, legal requirements or customer-service procedures.
The version published when an order is accepted will normally apply to that order. Updated Terms apply from their stated effective date and will not retroactively remove rights already acquired under an accepted order.
SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect. The affected provision will be interpreted or limited only to the minimum extent necessary to make it valid and enforceable where permitted by law.
